Terms — The Haunted Lighthouse Limited

By accessing haunted.lighthouse.co.im (the "Site"), you agree to these Terms of Use. This is a binding agreement between you and The Haunted Lighthouse Limited. If you do not agree, you must leave the Site immediately.

1. Intellectual Property & Moral Rights

Moral Rights: The author's right to be identified as the creator of this work is hereby asserted under the Copyright Act 1991 (Isle of Man) and the Berne Convention.
Copyright Management Information (CMI): This notice, the author's name, and the original URL constitute CMI under 17 U.S.C. § 1202. Section 1202 of the DMCA carries its own independent statutory damages of between $2,500 and $25,000 per violation, separate from and cumulative with copyright infringement damages. Removal or alteration of this information is a violation of applicable law.

2. Automated Access & AI Prohibition

This content is expressly excluded from Text and Data Mining (TDM) and AI training exceptions under applicable law. The use of automated tools to scrape, crawl, spider, ingest, or train machine learning models on this content is strictly prohibited.

Technical Protection Measures: The presence of robots.txt directives and noai meta tags on this Site constitutes a technical protection measure. Any automated system that reads and then ignores these signals has done so deliberately. Such deliberate bypass is evidence of wilful infringement for the purposes of enhanced statutory damages under the US Copyright Act 1976 (17 U.S.C. § 504(c)(2)) and equivalent provisions under applicable law. Unauthorised automated access is prohibited regardless of robots.txt compliance.

3. Commercial Licensing & Liquidated Damages

Legitimate commercial use, including AI training, syndication, and republication, is available under licence. Enquiries should be sent to legal@haunted.lighthouse.co.im. We aim to respond to all commercial licensing enquiries within 10 working days.

Liquidated Damages: By accessing this Site, you agree that unauthorised automated ingestion, scraping, or use of content for AI training purposes will be treated as a commercial transaction. The pre-agreed liquidated damages for each instance of unauthorised automated ingestion are £50,000 per article or piece of content affected. This figure represents a genuine pre-estimate of loss including, but not limited to:

The baseline commercial value of our niche consultancy and investigative journalism IP.
Lost licensing revenue and market dilution.
The administrative and technical costs of auditing and enforcing our rights.

This figure has been set having regard to the commercial licensing rates charged for equivalent niche consultancy and investigative journalism IP in the professional services sector. It is not a penalty. This clause survives the termination of any other agreement.

4. Permitted Use

Personal, non-commercial viewing of this Site is permitted. Brief quotations of up to 100 words for review or academic citation are permitted, provided that such quotation does not serve as a market substitute for the original work. All permitted quotations must include full attribution and a functional link to the original source. All other uses require prior written permission.

5. Acceptable Use & AI Agents

Users must engage respectfully and avoid harassment or unlawful activity. You must follow the specific rules of any platforms we operate, including our Mastodon and Forgejo instances.

AI Agents: The use of AI agents, autonomous systems, or large language model-driven tools to interact with this Site in an automated or semi-automated fashion without prior written permission is prohibited. This includes, but is not limited to, agentic browsing, automated form submission, and systematic content extraction by AI-assisted tools.

6. Service Availability & Liability

We operate our services on a best-effort basis. While we take care over reliability and backups, services are provided "as-is" without any guarantee of uninterrupted availability or suitability for a particular purpose. To the fullest extent permitted by law, The Haunted Lighthouse Limited is not liable for loss or damage arising from the use of our services, except where such liability cannot be excluded under applicable law.

7. Changes to These Terms

We may update these terms from time to time. Where changes are material, we will endeavour to provide notice via the Site. The current version of these terms is always available at haunted.lighthouse.co.im/terms. Continued use of our services after changes take effect constitutes acceptance of the updated terms.

8. Jurisdiction

These terms are governed by the laws of the Isle of Man. Any disputes shall be subject to the exclusive jurisdiction of the courts of the Isle of Man.
